Washington Legislative Update

Washington’s most recent legislative session has resulted in several bills that will impact associations.  Some have already been signed into law while others have passed both the House and the Senate and are on the Governor’s desk awaiting signature.  Below are links to some of the bills that will impact associations in Washington. 

SSB 5011:  This bill addresses electronic meetings and notice provisions for common interest communities, condominiums, and homeowners' associations.  It impacts RCW 64.32, 64.34, 64.38, and 64.90.  This bill has passed out of the legislature and is awaiting the Governor’s signature. 

ESSB 5024   This bill amended RCW 64.50.040 to clarify that the qualified building enclosure inspector may be the architect or engineer of record for the project.  This bill has passed out of the legislature and is awaiting the Governor’s signature. 

SSB 5034    This bill repeals the existing non-profit corporations act (RCW 24.03) and replaces it with a new non-profit corporation’s act.  The new number for the new chapter in RCW 24 has not yet been established.  This bill has been signed by the Governor and contains several effective dates. 

ESHB 1108:  This bill maintains funding and assistance for homeowners navigating the foreclosure process.  The effective date of this law will be July 25, 2021. 

EHB 1482:  This bill addresses foreclosure protections for homeowners in common interest communities.  This bill has passed out of the legislature and is awaiting the Governor’s signature.
