Treasure Island Country Club (TICC) is a homeowners association located in Case Inlet in South Puget Sound. Our island had been connected to the mainland by a wooden bridge built in 1953. The bridge was definitely showing its age with many restrictions imposed as to the amount and weight of vehicles. For example, we did not allow any concrete mixer trucks on the island to deliver concrete. Any one building a home on the island would need pickup truck hauled concrete mixers to deliver concrete. Not a good solution.

 Our present board was elected on the promise that we would either repair or build a new bridge. In addition to talking to engineering and construction firms we knew that we needed a top flight law firm that is able to address all of the issues that will confront an HOA planning a major capital expenditure. We selected Barker Martin after meeting with them in their Seattle offices. Both Dean Martin and David Silver were part of the original team.

One of the decisions the board had to make was how we were going to use the law firm. In the past we would consult with our attorney on a very informal basis. We never invited our attorney to our board meetings or annual membership meeting. After much discussion the board agreed that we involve Barker Martin in our decision making process regarding financing and presentations to the membership. The board was also encouraged to have any difficult issues presented to Barker Martin for their input.

Dean Martin and David Silver attended one of our first summer membership meetings where the bridge was discussed. The meeting was quite successful as many questions were answered by Martin and Silver. The decision to invite our attorneys to the membership meeting was ratified by the reactions of the membership. Accordingly, we invited David Silver to several more meetings. David was also very helpful in our negotiations with our lender for the bridge. Our membership now expects that we will involve David Silver with any of our legal issues.

We now have a new concrete bridge with security cameras linking Treasure Island to the mainland. We value the assistance provided by Barker Martin and David Silver

I cannot provide a strong enough recommendation for the entire Barker Martin team! They provided sterling legal representation for our condominium association involving complex construction defect claims. Dan Zimberoff and the entire Barker Martin team obtained a terrific result for the homeowners in the underlying construction defect lawsuit, and then when the insurance company for one of the subcontractors refused to participate in the settlement, they aggressively pursued bad faith claims against the large insurance company for the contractor. Though it took two trial court judgments, two court of appeals' opinions and a Washington Supreme Court decision, we withstood the insurance company's attempt at "war of attrition" and prevailed with a multi-million settlement. Throughout the entire process, Dan Zimberoff and the entire Barker Martin team exhibited extraordinary determination, resourcefulness and legal acumen. At the end of the case, not only was each of the homeowners reimbursed for all costs, but Barker Martin had also made new law in Washington favoring insurance policy holders. We would never want to have to repeat the process, but if we had to, we wouldn't want anyone else representing us other than Dan Zimberoff.
